What course of action would I have if I've experienced treats on the Job from a co-worker and this has not been the first time with this employee? The company has really done nothing but move the employee across the floor. It is affecting my ability to work.

It all depends how this injury happened. If this was a work injury, all medical expenses as well as loss of income are recoverable.

If the injury was sustained in a way that no insurance company can be held responsible, your pain and injuries are worth nothing. No lawyer will take a case unless someone with deep pockets is paying the tab.

It's not about $, it's about the injury and the treatment and the pain and suffering. I would say (and the rental car is not part of your injury claim) to expect an offer of around 6, maybe up to $7500 if you are dealing with a state where out of pocket meds or wages have to be considered. So that would include the 3200 (or the 3200 less your rental, because that's paid out of the property damage). If you're offered more or less than that don't get mad at any of us, because you didn't tell us anything about what happened to you or your treatment.

Also, 3 times specials is what all attorneys hope to get and tell their clients, but that still means you get 66% of the settlement, which doesn't make you better off. If you don't have an attorney, don't get one and don't expect a big pay day

I am a paralegal for a personal injury attorney in Texas. Many rules have changed over the years. You used to be able to take your medical and lost wages and multiply them by 3 to get a ball park figure on the worth of your case. Unfortunately, with the lawmakers we currently have elected into office, they lean more towards the insurance companies on these type of lawsuits. Another new "rule" is that they only pay what the medical expense ended up being. For example: Your hospital bill is $25,000.00, insurance paid $13,000.00 and the hospital wrote off $12,000.00. Then, the insurance company would only count the $13,000.00 that was actually paid for the medical expense. If you have tax returns to prove your loss of income you are in good shape because that can't really be disputed. With medical bills and lost wages that high, you will probably end up going to trial. Good luck!

It's totally different for each case. You can see what the other company offers you and go from there. You could go for a free consultation at an attorney's office and see what they think, but don't expect much compensation unless you were really hurt bad or laid up for a long time.

Insurance adjusters usually multiply your total damages from 1.5 to 5 times. They almost always start at the lowest amount. I do know that here in NC-you can also get the diminished value of your car from the damages it sustained if you request it within 30 days of the accident. Ask about it....Not many people know that. I sent an email to our insurance commissioner to make sure about that, and he confirmed it.
Also, keep track of your mileage to and from your doctor's appointments.

If it were me, I would put a $ amount on my medical bills, lost wages x3, and hope that the jury sympathizes because they can award punitive damages with NO LIMIT on the amount

My lawyer told me the settlement value should be approximately 3 times the amount of the monetary damage you have suffered. So for you, around $9,600. (That's if you just settle with the insurance company, without a lawyer & without a law suit.) However, if there is some kind of permanent damage to your bodily health, you can get much more. You'll probably need to file a law suit though.

IF a law suit is required, be sure to do so within the 2-year statute of limitation! (At least that's the IL rule.)

I don't believe that you have too much to worry about here. Most personal injury attorneys will need solid evidence to prove a case. This man may only have a few visits to a specialist, but if there are so substantial injuries, a lawyer will have a hard time convincing a jury to give the man money. My guess is that after speaking with a lawyer, he will realize that the cost of a civil suit and legal fees will be higher than any punitive damages that a jury might incur. Furthermore, his insurance company will probably come after you for minor medical bills, but only if he has insurance and claimed the accident immediately.
