I have a new housekeeper starting soon, in my home….and I’m looking for a personal injury release form, but I can’t seem to find any related to home employment services. Just some kind of consent that she understands there will be slippery floors when she mops and lifting the mop water and could fall down the steps and so on. The standard stuff but I can’t find a sample on the net. Anyone know where I can find something so I don’t have to make one myself? Thanks a lot.

Can a landlord have a tenant sign a waiver to injury or personal property damage in California?
Filed Under Renting & Real Estate | 2 Comments
Is there a waiver form or something similar in which a tenant can sign to waive their right to make claims against the property owner for injury or damage to the tenant’s personal property in California? Please send links or some ideas of what is possible to write up to include in a rental agreement or separately in a waiver. Thanks.

How do you calculate how much a personal injury claim from a car accident should be?
Filed Under Insurance & Registration | 4 Comments
I was a passenger involved in an accident that was the other driver’s fault. My arm was broken in an awkward place and my doc says it may not heal. He’s ordered a bone growth stimulator to help the healing process but my care is far from being over. The doc also thinks I may have to go back to surgery in a year to remove the plates he put in. i’d be in a cast again for 6 weeks.
My bills are already over 15k and I’m wondering if I can just go for the other person’s limits so that I don’t go into debt.
I don’t want to settle too soon but if there is a max that I can get anyway I would prefer to get this over with.
Also, if my claim is higher than the other person’s limits would the underinsured coverage from the driver of the vehicle I was in pay up to her limit?

Is it a requirment for a personal injury attorney to have a college degre or be board certified?
Filed Under Higher Education (University +) | 3 Comments
Having an argument with a friend over this topic. If you look in the phone book, there are tons of attorneys with full page ads that specifically say….Not certified by the Texas Bar of Legal…..which means they may or may not have a degree, but for sure arent board certified. I have found on the net that there are 7 states that dont require a law degree. Is texas one of them?

What is the average (or percent) lawyers usually take out in contigency fees in a personal injury case? ?
Filed Under Law & Ethics | 4 Comments
I’m in California. There are some law firms that will handle personal injury cases on a contingency fee basis (e.g. they only get money if you win a settlement). Does anyone know the average percent or fee they take out?

How do I collect personal injury protection from my car accident?
Filed Under Insurance & Registration | 4 Comments
Yesterday, I was driving across a bridge when a car coming from the opposite direction swerved into my vehicle and sent my car over the bridge and into the water. Since then, I haven’t been able to find the number of my insurance company (it’s a mom and pop business) and have no way of getting from point A to point B because I can’t leave my house without seeing worms in the sky. How do I inform my insurance company and get my PIP?
